It is not my intention to comment on the innocence or guilt of Mr. Smith. But it is easy to see inconsistencies in print, being it is usually in black and white. Not only does the reporting and accounts by witnesses vary over time and venue, but there seems to be a person on interest to me that all but disappears from the narrative.

Most peculiar is the statements of the "girlfriend". Was the "girlfriend" one of the roommates? Is this an interchangeable title given the difference in reports and times reported? At my most suspicious, I can only hope the "girlfriend" wasn't allowed the status of roommate in exchange for incriminating statements, when in some degree of probability she may have been an accomplice.

I am also wonding where the composite came from. It comes a day after the occurance. Seems from the reporting, the perpetrator, did not face the victim. Her injuries seem consistent with a face forward landing.

During the trial Mr. Smith states the victim cannot identify him. It is also reported that she is not present. I don't think counsel would have allowed the statement if it was not fact. She is standing there with him.

I also wonder about the "minor injuries" coming from being "slammed" onto the ground. At 5'4" 175, I would think Mr. Smith would cause much more damage.

Honolulu police are searching for a man they say is considered dangerous and is suspected of kidnapping and raping a 25-year-old woman on Wednesday night.

It happened just after 8 p.m.

A 25-year-old woman who works at the Wahiawa Shopping Center just got off from work and was heading home when she was attacked.

Police say the woman was just yards away from her workplace making her way down a stairwell when the man grabbed her from behind, covered her mouth with his hand and slammed her face into the concrete.

Police say he demanded money, threatened to kill her, raped her, took her purse then ran away. “We are hoping there are witnesses because there's many businesses in the shopping center,” said Sgt. Kim Buffett of Honolulu CrimeStoppers.

The victim was taken to the hospital in stable condition.

She suffered minor injuries to her face, knees and head.

Residents who live in the area are shocked by the brutality of what happened in their neighborhood.

"I mean children are still seen walking around at that time, so to know that a 25-year-old woman was attacked and raped who knows what can happen to the children,” said Tony Sarvi.

Police say they believe the attack was completely random.

"He might hang out in the area, we don't know, we are hoping that somebody may recognize him,” said Buffett. “So we hope that anyone who has seen this male who is an African American male in his 20's, 5'4", 175 pounds, short black hair more like a shaved black hair and wearing a gray polo shirt and long denim pants.”

Police also say this suspect is considered dangerous and advise residents to walk in groups.

WAHIAWA (HawaiiNewsNow) – Honolulu police have made an arrest in a sex assault case in Wahiawa last Wednesday. 30-year-old Tyrone Smith Jr was taken into custody Friday afternoon in Wahiawa.

Investigators say that Smith sexually assaulted a woman on the back stairs of the Wahiawa Shopping Center at around 8:00 PM Wednesday night. In addition, police say that Smith took the woman's iPod, jewelry, cash and a bank card after slamming her to the ground.

Police say tips from Smith's roommates led to his arrest. They say one of his roommates contacted police Friday morning to tell them that Smith might be the suspect they were looking for in the case. The roommate told police that Smith had told her he committed a robbery on the stairs behind Goodwill. The roommate also told investigators that Smith "put his knee on this woman's head" and "took this woman's money and jewelry". She told police that there was a bank card with the victim's name on it in a trash bin.

Another roommate subsequently told police that Smith had told her he robbed a woman at the shopping center and showed her a bank card with the victim's name on it.

Smith has been charged with first degree sexual assault.

Police are seeking help in finding a man who sexually assaulted a woman in Wahiawa last night.

Man sought in Wahiawa sex assault

Police are asking for the public's help to find the man who sexually assaulted a woman last night at the Wahiawa Shopping Center.

The woman in her 20s was walking down the stairs at 823 California Ave. when the man came up from behind, demanded money and then sexually assaulted her, police said.

(NO THREATENING OR SLAMMING)

The man, in his 20s, is described as being 5 feet 4 inches tall and weighing 175 pounds, with short black hair. He was wearing a gray shirt and long denim pants.

Police said he is wanted for first-degree sexual assault.

Anyone with information is asked to call CrimeStoppers at 955-8300 or *CRIME from a cell phone. Anonymous text messages can be sent to 274637 or CRIMES from a cell phone along with "CS808" in the message.

A man accused of raping and robbing a woman in a Wahiawa shopping center last week made his first court appearance this morning.

Tyrone Smith, Jr., 30, was charged with first degree sex assault, kidnapping and robbery.

According to court documents, smith allegedly told his roommate he had committed a robbery “by the stairs behind Goodwill.”

Court papers say smith also told his roommate he had put his knee on the woman's head and took her money and jewelry.

Smith's roommate told police she found the victim's credit card in her trash.

Court papers say smith made a similar confession to another roommate.

Smith's bail is set at $500,000.

A 30-year-old Wahiawa man charged with sexually assaulting and robbing a 25-year-old woman Wednesday at a Wahiawa shopping mall bragged about the attack to his female roommates, who then tipped off police.

Police conducted surveillance at Tyrone Smith Jr.'s Lakeview Circle apartment Friday and arrested him.

Smith was charged Saturday with first-degree sexual assault, kidnapping and second-degree robbery. He made his initial appearance in court yesterday.

The victim told police she was walking down the stairs at the Wahiawa Shopping Center, 823 California Ave., when a man came up from behind her at 8 p.m. Wednesday, demanded money, sexually assaulted her and took her belongings.

According to court documents two roommates he robbed a girl at the mall.

Smith told one roommate he had "slammed the girl to the ground and took her iPod, a silver chain and a ring," a police affidavit filed in Honolulu District Court said.

Smith also described to the other roommate how he put his knee on the woman's head and took her money and jewelry, the affidavit shows. The roommate also found a credit card in her trash bin with the victim's name on it.

Smith and his girlfriend also showed a bank card with the name of the victim to the first roommate, the affidavit said.

Smith remains in custody at the Oahu Community Correctional Center, where he is being held in lieu of $500,000 bail.

THE GRAND ILLUSION - Here’s the Hawaii rationale that if everybody is harassed by one group or another there is no harassment, really. Actually, you're lucky to be included. It's Aloha.

A minimal observance of social interaction will show, “the gang" fares better than "easy prey". No 'equal opportunity' there. "The gang" has always tried to inspire guilt in those who stand apart, like, on their own two feet.

I also doubt if bullying has become the norm, where most are harassed instead of normal social interaction. Unless this is a peculiar aberration of high school life, in Hawaii, that most people don't know about, or want to learn to accept as growing pains.

Nov. 16--"Kill Haole Day" is largely a myth. That a federal judge has cited it as a long-standing island tradition in a legal opinion is shocking, damaging and wrong.

Yes, start your venomous e-mail to me right now. Tell me that your sister's friend's cousin's ex-boyfriend used to live in Hawaii in 1973 and he swears "Kill Haole Day" not only happens, but is a huge event, like Christmas or May Day. Tell me I'm protecting the horrendous practice by pretending it doesn't exist.

Here's the thing though: Name names. Give dates and locations. Where exactly did this occur? To whom? What specifically occurred and who were the perpetrators? Because if this is a widespread racist crime that has become a tradition in Hawaii, why are there no records of it? The judge (in an appeals court ruling on a case against Kamehameha Schools) cited a brief 1999 newspaper story that quoted a Republican state senator who claimed it was a tradition. No data, just inflammatory assertions by a politician.

If it is true, somebody should be documenting the details of each incident, so send them to me. I'll compile a report and send it wide, because if this is really a tradition, it must be stopped immediately.

I'm not saying it never happened. White kids do get picked on in Hawaii schools, as do Hawaiian kids and Filipino kids and kids of every race, color, shape and size. Getting picked on in school is part of most people's childhood regardless of who they are and where they go to school. Though common, it's not OK, and that's why there are so many anti-bullying campaigns.

In 12 years of attending Hawaii public school and 20 years of covering news in Hawaii, I have never once come across an actual report of a "Kill Haole Day" assault. High school fights, yes. School yard violence, yes. Race-based gang brutality, yes. But not an established, traditional "Kill Haole Day."

The existence of the term "Kill Haole Day" is bad enough even if nothing ever happens. No kid should live in fear of that threat. But the people who perpetuate that myth want to believe that when it comes to bullying and prejudice, they've got it worse than anyone else.

Has a white kid ever been harassed on the last day of school in Hawaii? Sure. Mostly water balloon fights or silly string attacks. Sometimes worse. But it's equal opportunity harassment.

Hawaii schools have a long way to go to achieve tolerance, safety, compassion, acceptance for all students. But insisting that there exists this decades-long tradition of setting out to hurt white kids one day a year doesn't help because it isn't true and it takes away the focus from the problems that are real and should be fixed.

The Hawaii Friends of Civil Rights is awarding its annual Dr. Martin Luther King Jr. Friends Awards.

The two individual honorees are longtime civil rights advocate and state Board of Education member Kim Coco Iwamoto and retired University of Hawai'i professor Miles M. Jackson.

Two organizations — The Japanese American Citizens League of Hawai'i and UNITE HERE Local 5 — are also being honored.

Hawaii Friends of Civil Rights noted that the Japanese American Citizens League has a mission to protect the civil rights of Japanese-Americans and all victims of injustice and discrimination.

It says the union's efforts have raised the standards of wages and benefits for all of Hawai'i's workers in and out of the tourism industry.

Chronology:

Jan. 14, 2011: Librarian, Michelle, says I must relinquish my place at

the computer to a man that came in after my card was reset and I was at

the computer. Ms. Diane Eddy the director gets within inches of my face

while at the station and repeatedly demands and requests me to give up

the session, and Ray, Star Security Guard, calls the sheriffs to have me

removed from the library, after Ms. Eddy says I am causing a

disturbance. Ms. Eddy uses the term "as a courtesy to me" when

repeatedly demanding and requesting that I relinquish the seat.

Aug. 7, 2010: My MP3 player is stolen at the library. Officer Roden

makes it 'Lost Property'.

July 21, 2010: A bag containing police reports made by me are stolen at

the library.

June28, 2010: My bag stolen at the Ala Wai.

July 16, 2009: My tax transcripts are stolen at the State Library.

These included a set that was sent to me unsealed. There are

discrepancies in my name, address, wages reported, and withholding.

Jun. 24 - Today, I go to the police station and inquire about these two

reports (199784 152479). I find that there is no statement filed for

either. One is for the bag, which did not contain the two recorders and

two tapes when I claimed it. I also find Off. Lee left of one recorder

and the tapes from his report. Also, the report number now jibes with

the number in evidence, as it did not when I claimed the bag.

May, 2010 - I updated my registration to vote in the 2008 election

because I had left my last address, although living in the same area and

having the same polling place - McCully. I voted in the last national

election at McCully.

I went to the office in City Hall to update again, this past Wednesday,

for the special election coming up. I was told that I hadn't done any

action since 2006.

Apr. 2010 - I called an officer to report what I believe was a theft.

The officer told me that since I did not purchase the item and there

would be difficulty in obtaining fingerprints, he could not make it a

theft, but instead, MISC PUB.

When I went to the Police Commission, I was told any investigation would

be hampered by the inability to collect possible fingerprints.

Apr. 14, 2009 - The IRS tells me there is a 1099 in my name for 2007. I

never applied for social security, never received a check from social

security, or cashed a check from social security. The SSA tells me there

is no record of a 1099 in my name.

Mar. 19, 2009 - Emails I had in my AOL account have vanished. The

emails were between Ms. Mason and me when President Obama was Senator of

Illinois. Who would want them gone?

Seems anyone can come to the Hawaii State Library at any time and do

anything they want with, on, and at the public computers.

Aug. 18, 2008 - I go to the police station to get a copy of the report

made to Officer Porter. The statement is still not with the rest of the

paper work. My statement contained more detailed information about what

was inside, including my passport and birth certificate, and numerous

correspondences with government agencies.

Jul. 27, 2008 - I return to the police station to make another report

and statement, this time with Officer Porter.

Jul. 21, 2008 - I returned to the police station downtown to complete

the report with Ms. Aksionczyk, at 5:40 in the morning on Monday and was

told by the officer on duty at the receiving area that she would be in

at 6:00... I waited until 6:00 and inquired with a different officer,

and was told that she would not be at the receiving area until 10:30 -

2:30. I tried again during these hours, without success.

This has been 5 days now and no report has been generated and I cannot

get a number to reference concerning the case. I need to know how to get

the report filed and a number to reference with further correspondence.

Jul. 19, 2008 - I made a report to an officer by the name of Lisa

Aksionczyk, on Saturday of this month, about a stolen backpack I left on

the route E bus. Ms. Aksionczyk suggested at the time, that I inquire at

the lost and found department of The Bus. I thought this was a good

idea, so that a Good Samaritan would not have the unpleasant experience

of someone thinking they were a thief.

I went to the nearest stop I knew the bus would stop at on its return

trip. I saw the driver, recognized as the one I rode with and waited for

him to stop. I asked if it was turned in. I was told no by the driver. I

asked the driver's name. He told me Raymond.

I asked where the bus terminated and Raymond told me Waipahu. I

subsequently found the bus terminates in Ewa.

RAYMOND LIED.

The only time I could check with The Bus lost and found would be the

following Monday, it is not open on weekends. I did call The Bus, on

Saturday, with an emergency report because there was important ID in the

backpack.

I was told by the representative that no backpack was turned in. On

Monday I went to the transit center to inquire in person, and was

disappointed to be shown backpacks that were not mine...

Jan. 2008 - Unlike the DCCA of Hawaii, who I supplied documentation to,

the Department of Health and Human Services "Region 10", without

documentation, finds that Dr. Au did violate the privacy act by charging

me too much for copies of my records. But, Region 10 tells me they

cannot precede on the 6 other allegations

1. Along with saying I did not see as well with the new glasses, I said

that the prescription that I was given was weaker than the one I had the

previous 7, count them, seven years. Your office, nor the DCCA,

responded to this charge.

2. The reason I asked Dr. Au to change the prescription was because the

NEW one, I repeat, was weaker in one eye. This was the only alternative

Dr. Au gave me other than accepting the weaker prescription.

3. The "Vision Certificate" Dr. Au provides, had no license number where

it should have been and she did not sign it where it should have been

signed.

4. Dr. Au refused to give me photocopies of my records and did not give

me a reason, per her offices policy, when I asked for them in her

office.

5. Dr. Au charged me 2.00 dollars per page, totaling 20.00 dollars,

which I believe is exorbitant.

6. There are conflicting numbers on my records that I would like

explained. This, no one has addressed. And I doubt that my records were

reviewed by an impartial optometrist, as any reasonable person would

assume to be a part on what your office calls an investigation.

7. I was trespassed from Dr. Au's office for no other reason than asking

for copies of my files, and in her response to the DCCA she says I was

escorted out of her offices by mall security, which is a lie by an

optometrist that practices deceit.

Nov. 2007 - My complaint about Central Pacific Bank is not sent to the

FDIC regional offices in California. Instead it is sent to Kansas City.

Missouri. The response I get from FDIC says my concerns are contractual,

although I point out two misrepresentations by the bank's compliance

counsel, Judith A. Villarreal.

Ms. Villarreal says I did not contact Mr. Clint Arnoldus, Mr. Dennis K.

Isono. I have Certified Receipts and electronic verification from USPS

that says I did.

Coincidentally, there are officials at the Kansas City offices with the

name Villarreal: Jesse O. Villarreal Jr., Lisa M. Villarreal and Victor

Villarreal.

It is my opinion, that a person trained as a lawyer would verify facts

before submitting them in official documentation. Therefore, I can only

assume that Ms. Villarreal had a serious lapse in judgment, or she was

lied to by those she spoke with.

Mar. 2007 - My complaint to the Dept. Of Ed is refused on the grounds

that they do not fund any programs or activities at the Hawaii State

Public Library System, and therefore do not have jurisdiction.

If the situation is threatening enough to cause a change in levels

moment to moment, it stands to my reason, it would remain at a certain

level until there is a sufficient enough change or stabilization to

bring it to a lesser level. But that's just me.

Oct. 17, 2006 - I submit a complaint to the Police Commission relaying

concerns about the treatment I experienced at the security checkpoint at

HPD District 1 the previous day. An investigator tells me it is the

policeman’s job to "interpret the law".

Returning to the station to locate an article I left, I am told by

Officer Kahele, in the presence of one officer Hung, and another, that

it is mandatory that I produce ID, and that I remove everything from my

pockets, and take off my belt before passing through the metal detector.

I point out this information is not on the signs, and officer Kahele

says there will be no furthering of my purpose if I do not comply. After

complying, I am told by officer Kahele that I must sit down, or she will

not take my report. Previous to this occasion, when at the HPD

headquarters, I was never asked to remove everything from my pockets

and, or to remove my belt, or that I had to produce ID to enter. Officer

Lau, the sergeant for this post, tells me the same.

I am told by a detective that it is not mandatory to produce ID, "We

don't care who you are. Anyone has the right to come in here". Sergeant

Lau, who I am told is the officer in charge of the post, says depending

on the threat level, procedures may change day to day.

He says one may be required to remove everything from ones pockets etc.,

or be required to submit to different procedures. I inform him that on

the same day, when I was there previously, I was not required to do so.

He informs me that the security level may change from moment to moment.

Oct. 16, 2006 - I submit a complaint to HPD Internal Affairs relaying

concerns about not being asked to identify the driver of the vehicle

that hit me on the 8th of Sept., and the fact that the person who stood

as Chris Pa at the arraignment was not the driver of the car.

Oct. 6, 2006 - I go to the arraignment of A Mr. Chris Pa. I am surprised

to see that this Mr. Pa is not the driver I saw, while laying on the

hood of the car and peering through the windshield, and definitely not

the man I looked in the face and spoke to through an opened window.

This may be due to the fact that I was not asked to identify the person

located, arrested, or cited, on the night of the incident or at any

subsequent time, until I see him at the arraignment. I am directed by

the presiding judge to inform the prosecutor’s office, which I do.

Oct. 2, 2006 - I am told at traffic court there is no court date set,

but have found online there is one on Oct. 6, in room 4B, and I am not

included as the victim. I still get correspondence from the insurer's

agents telling me of medical coverage available, although I told the

driver, the responding officer, and previously the insurer's agent, I am

OK.

Sep. 21, 2006 - I go to City Hall to get a voters registration card and

am told it will cost .50 cents.

I am surprised to get a "Certificate", ala Lens Crafters, and ask is

this it? I am told yes by the clerk. Today, on "The Bus" I see a man who

says he works at the polls, who tells me there is still a little yellow

card that comes in the mail and is surprised to see the "Certificate".

Sep. 8, 2006 - I am hit by a car bearing license plate JST 203, that was

stopped at a crosswalk. The driver is looking at me when he accelerates.

The driver doesn't wait for police to arrive. They find him at his home.

The police report reads Crime Code 550, which I am told means, a

collision with damage of more than 3000 dollars. I am told the

responding police officer decides if there will be an investigation.

This is More, Honolulu HOKUM.

This is the place where, those who would complain about wrongdoing are

persecuted, harassed, smeared and railroaded. Where the perpetrators are

bribed to keep quiet, or go along with the cover-up, promoted, and

transferred.

Sep. 7, 2006 - A security guard, Solomon Save a, badge number - 90187,

at the Hawaii State Library, calls me a "ni - - er" twice" in the

library foyer, in a loud voice.

Aug. 10, 2006 - I have been told by Sen. Barack Obama's office, where I

sent this same correspondence, that someone from Sen. Akaka's office

would contact me, because Sen. Obama's office forwarded the

correspondence to them. I have yet to hear from Sen. Akaka's office. Is

there some assistance your office can give me?

Jul. 2006 - I have written to the Clint Arnoldus Denis Isono and Susan

Tachino asking them to explain, and have received no response.

Thank you for the assistance you have given. Please, do not contact

Senator Akaka’s office again, on my behalf. Unless there is some

necessary secrecy to an investigation he is doing, all I have received

from his offices is a letter in response to my inquiring about funds for

the Hawaii State Library. My concerns extend much further than this.

Hopefully, the light being shed on activities in the Justice Department

will lend itself to some justice for me. Otherwise, it will be nothing

but justice delayed and denied.

Jul. 23, 2006 - An Optometrist, Kim Agena at a Lens Crafters gives me a

prescription that is weaker than the one I had for the previous 7 years.

Doctor Au, a co-owner corrects this, but when I ask for photocopies of

my records the doctor refuses and gives me a hand written “Vision

Certificate" instead, that is not signed and does not contain a license

number where applicable. I have made a formal request in writing. They

have told me it will be at a cost of 20 dollars for 10 pages, which

seems exorbitant and requested that I not seek services at any

Optometrists in Lens Crafters.

The doctor, Au, is the co - owner along with Dr. Lau, of all the

Optometrist offices in Lens Crafters, in Honolulu. In other words, I

cannot get an eye exam at Lens Crafters. Is it considered rude or

threatening, to ask for one's records?

The advice I get here is nothing but a pack of lies.

The local ACLU has written me 3 differing and separate excuses why they

cannot or will not get involved, but never the conflict I found below.

Apr. 2006 - I have had two librarians and a circulation clerk tell me

there is no report possible for stolen books. They must be lost. This

would have caused fees to be incurred by me. I had to take the police

report to the State Librarian's Office to settle the matter and have the

fines removed from my account. This all could have been done at the

State Library.

Jan. 2006 - I have had two bank accounts affected. One because a deposit

I made to cover my use of overdraft protection was not credited; they

rescinded the "overdraft" and CLOSED my account.

The bank says it had to be held in the account for a day, to be

credited. Nowhere in the terms and conditions is this stated. The

depletion of the other account, I have been given no reason for.

Recently, I have made another complaint, in addition to the previous

five, to the USPS - OIG, about mail I am to receive or have sent. I sent

a certified letter to Richard E. Fairfax, Directorate of Enforcement

Programs - OSHA, in Washington D.C., on the 2nd of December.

The certification number is 7005 2570 0000 6898 2586. I look at the

track and confirm feature at USPS.COM and there is no record of it

having been delivered yet.

My case was dismissed May 24, 2006. How often does this occur? A case is

dismissed with two days difference between the dismissal date and the

termination date, (May 26, 2004) of the individual filing suit. I will

never understand how the three judges that made decisions in this case

could not see that it is too complex for anyone who would consider

themselves a pro se litigant, which I do not.

This has been an uphill battle against an opponent whose underwriters

include a Fortune 500 company, FNF.

My Information:

I have resided here in Honolulu, Hawaii for almost 4 years now. I had

intended to stay here when I made the decision to come, and was happy to

have found employment relatively soon. I found a job working with a

temporary agency for 4 months. I was hired by the client as a regular

employee, Sept... 2002. On my first day of regular hire, I was shocked

to hear, "you know why they hired him, don't you", from one of my

co-workers. But, needing to work for a living and being in a strange

place, I thought it best to ignore this, after all, I was hired.

At the beginning of my time with the client, Title Guaranty, I was told

by the onsite supervisor, that if I was to take a particular bus and

call her first, "there would be more work". The day after this I handed

her my time card, ready to seek another assignment, when she acted as

though she didn't know why I would be doing this.

When I explained, she countered with some nebulous words and said I

could work as long as the company needed me.

Subsequently, the same supervisor would tell me that I had to give her a

key or the combination to the lock on my locker, "in case of an

emergency". I thought this to be a strange request, as I could not

imagine an emergency in my locker that would require her or anyone else

to open it without me. I didn't respond to her request, and not hearing

anything further, I gathered that it was not company policy at all.

Having a co-worker refer to me as "boy" and another ask me 3 times -

after giving an answer twice - "why do black people use the N word?",

did not make me feel very gregarious among them. I was also told by a

co-worker, "all Hawaii is a gang brah", and by another, "it's all

connected", the supervisor speaking about a former supervisor said, "we

made him quit because he thought he was smarter than us, cause he was

from the east coast".

We were housed in a basement of what is now a former Costco building,

with an air-conditioner as the only ventilation.

When I noticed mold growing in a hole, in the wall beneath the

air-conditioner, adjacent to the room where I sometimes, but mostly my

co-workers would eat lunch, I asked them about it and was told that

management was made aware of it and did nothing. I decided to inform

management myself, considering the untruths I had previously heard from

some. I was thanked by the assistant to the woman in accounting who

handled the repairs for the building.

I did not think it was a major undertaking by a very successful company

to fix this problem, and was surprised at the length of time it was

taking to address the situation, so I informed OSHA, Aug. 2003. This is

when things started to go further south.

Coincidentally, the day after going to the OSHA offices, the next day at

work, my supervisor stated to a co-worker, "Vernon went to OSHA." This

information was not given to her or any co-worker, by me.

When I went to OSHA, the employee did not give me any type of reference

number, or write one in the space provided on the complaint form, nor

did she inform me at that time that mold is not OSHA'S jurisdiction,

which is what I was told when I went to check on the status of the

complaint. Neither, did the employee inform me of laws governing

discrimination.

I was also told - it not being OSHA'S jurisdiction - the complaint was

referred to the Department of Health. It was like pulling teeth to get

an answer as to what office at the DOH it was referred to. Needless to

say I could not inquire about the possible disposition of the complaint,

not knowing where to inquire.

I made a complaint to the EEOC, Jan. 2004, and the Hawaii Civil Rights

Commission, Apr 2004, both of which were dismissed without any

investigation. Each agency sat back and waited for the submission of the

company's response, giving them numerous extensions. Incidentally, I was

contacted by the director of the EEOC, asking me if I wanted to proceed,

after I was shown a copy of the company's response, which I don't

believe is proper.

I now see in the EEOC's and the HCRC's own publications, matters such as

mine that were investigated and even adjudicated. During the HCRC's lack

of investigation, I only heard from them at the intake and when I

received their letter of dismissal.

I now find the investigator did business with my former employer. I

furnished the EEOC and the HCRC with names of co-workers who said they

would speak for me. They were not interviewed. I was informed by an

investigator at the EEOC that no one visited the site.

There was a similar situation here with UPS, where an employee was fired

for doing less egregious acts than his co-workers, which I believe is

the case here. I saw co-workers break company equipment, cuss freely,

ask for sexual favors, and bring children and friends to the work site.

Throughout this experience I have been told by these agencies' staff and

lawyers, literally or in effect, "there is no smoking gun here". This is

only due to there being no investigation. In the least, there is a

pattern that should compel any thinking person to ask questions.

Subsequent to this, my work was sabotaged on more than one occasion, and

reports to management only resulted in them twisting the situation in

attempts to placate me and set me up for these spurious accusations by

my co-workers.

Each complaint of mine was a matter of my erroneous "interpretation", as

stated by management (Myron Koizumi), while my co-workers complaints

were valid descriptions of my "misconduct".

As a result of the accusations, I was suspended, without pay, pending an

investigation for, I kid you not, a co-worker accusing me of harassing

her by clapping my hands and signing "Pink Cadillac", and another

saying, I was teasing her when I asked her to say my name and that of

the manager, to see if I could distinguish the two.

I was terminated in May 2004, two weeks after the dismissal of the EEOC

complaint that was not investigated, and a day after informing

management that I overheard a co-worker saying to the one that accused

me of harassing her by singing, "we're going to show him the power of pu

- - y.

I was denied unemployment insurance, June 2004, with a fact-finding

interview done over the telephone that was not reviewed or signed by me,

as it should have been before it was made part of the official record

and used at my future appeal.

The subsequent appeal Aug. 2004 was biased, prejudiced, and contained

perjured statements by the witnesses for my former employer. I am now

told that the recording of the hearing does not exist because it was

transcribed.

I have initiated a suit in federal court, Jan.. 2005 that I cannot

pursue, due to the lack of time and funds necessary for an undertaking

such as this, and the skill I do not have in these matters.

I have all but given up searching for representation, believing word has

gotten to many legal ears on the island and no one wants to go against

the state that has all but coddled and cuddled business here.

I have contacted the ACLU, and given them much information, but they

seem more interested in writing briefs for exotic entertainers, arrested

for doing lap dances. First they tell me they cannot help unless the

matter involves a government agency, then they tell me they can if a

decision is against me, then they tell me they do not have the manpower

and time. Each of the criteria, I met at the time I contacted them.

Coincidentally, I find a lawyer, Roger Fonseca, at the firm representing

my former employer, is the national representative for the Hawaii

chapter of the ACLU. And their staff also has names that are the same as

those associated with Hawaii real estate. They cannot help, but they can

accept my information.

I have tried to interest many, many lawyers and firms by email, letters

and personal visits, to no avail. I have had a lawyer in San Francisco

who participated in a well-known case here try to find someone without

success.

This situation has been surrounded by complicity, cronyism, and bias.

I have written to the DOJ, only to have my information shuffled from one

agency to another, including the Department of the Interior, of all

places, and finally coming full circle to the Hawaii Department of

Labor. I do not think this was coincidence. At the HCRC, there is a

commission chair, I have found, married to one my former employer's -

one Coral Wong Pietsch.

Mrs. Pietsch is a general in the U.S. Army Reserve, and an attorney, a

very powerful position with ties to D.C., I'm sure. It has long been my

suspicion that this may have played a role in the lack of effort on the

part of officials that has attended this matter. Each party's history I

research has some relation to another, be it professional, academic, and

even familial.

I now look at web sites for all the organizations I sought help at - the

Governor and Lieutenant Governor, all representative's and senator's

offices, Legal Aid Society, Hawaii Dept. of Labor and the DOL -

national, EEOC - Hawaii, district, and national offices, NAACP Hawaii, ,

ACLU of Hawaii, Hawaii - Department of Health, HIOSH and OSHA ( regional

and national ), the Hawaii Office of Information Practices, the

ombudsman's office and Volunteer Legal Services of Hawaii.

Concerning Volunteer Legal Services of Hawaii, I have recently

discovered that one of two lawyers they referred is an attorney at the

law firm representing my former employer, and the other is a realtor in

Honolulu, and also licensed to practice in California. And another is

the member of a firm with old ties to the Pietsch family. Who were these

lawyers going to "help"?

At the Hawaii Civil Rights Commission, and Hawaii Ethics Commission, I

find the persons responding to my letter, did business with my former

employers and my letter explaining the situation and their reply

stating they could do nothing, are the only correspondence I had during

their "investigations" or dismissals.

I have sought assistance at the Hawaii State Bar Association, where the

lawyers who are members of the Real Property and Financial Services

Section, are also affiliated with these other organizations, or directly

associated with my former employer, or the firm that represents them -

Torkildson, Katz, Fonseca, Heatherington, and Moore.

The Real Property and Financial Services Section includes a lawyer I was

assisted by, one Andre Wooten, who at the time told me nothing of his

involvement with this organization.

He was suggested to me by church members and NAACP officer, Alfonso

Braggs. I pull up the staff or the particular board of directors of

these organizations and there are last names that are the same and have

some relationship, mostly with real estate, and more than a few with

ties to California.

Two names in particular are quite suspicious. Kouchi is at Volunteer

Legal Services. It was also the last name of the HR assistant at Title

Guaranty. Pang, is the name of a front desk worker at the YMCA, whom I

complained about signing for my mail. It is also that of an Appeals

Officer at Department of Labor - Security Appeals Referees Office.

Hirayama is the name of the appeal's referee and also that of the owner

of the restaurant at the YMCA.

I mention the YMCA because in 2002, I had complained about what I

believed to be prostitution, facilitated by staff there. And when I

informed the supervisor at Title Guaranty, her response was to leave

well enough alone, after I informed her that I had, in my opinion,

angered some people there.

My subsequent report to the police department was investigated by the

police calling the YMCA and asking them if my suspicions were true. I

think you can see what position this left me in. In my lay opinion, this

was a sloppy and dangerous way to initiate and conclude an

investigation.

There are too many relationships here to be mere coincidence, and are

questionable, at least.

My information was passed by one Elaine Chao - Department Of Labor, in

D.C. to Tin Shing Chao Department of Labor here in Hawaii, who used an

erroneous date to nullify my complaint. This was after a layover in

California with Ms. Alison Pauly at the regional offices, whose CASPA

investigation stated that I should have made this a written complaint,

when Hawaii law states it does not matter, whether written or verbal.

Could she be related to the Paulys who have donated to the University of

Hawaii, and have owned land here?

The complex in Hawaii that houses the Department of Labor is also where

the HIOSH offices and the Hawaii Civil Rights Commission offices are

located. This name, Pang, pops up in various places dealing with state

government and real estate. I now know these agencies to be straw dogs

that do everything but contend with the status quo.

For the most part, the agencies that pretend to help, most notably the

NAACP and ACLU, only collect information and then say they can do

nothing; I wonder what happens to the information in a state that treats

confidential information as a commodity. Incidentally my former

employer's representation is one of the largest contributors to Legal

Aid Society.

I have applied for many positions since my termination, and have only

worked sporadically in spite of my efforts. I have registered with many

staffing agencies - Olympia, Hawaii Staffing, Snelling, and Hawaii Temp,

CTA Staffing which is now Bishop & Company, Manpower, Kelly, and POI. I

have not worked a complete week and have not been contacted at all by

some. I registered at Altres in 2004, and was not called in a year’s

time before I returned. There, I was terminated for, “not being

proactive".

There is no confidentiality law here, and I believe this also has worked

against me. It - confidentiality - has been frequently cited by my

former employer's agents and state officials, only to protect their self

and facilitate their deceptive practices.

I mostly use the public library to use the Internet, i.e. write letters

and do research. Needless to say, this is not the most secure

environment to do this type of activity. And I have had problems at this

library with the computers and the staff.

At the library, I have seen the text change when I am typing, without

commands initiated by me. The printer is connected to the computer at

the librarians' desk. On one occasion, I was told by a security guard

that a librarian had complained about me harassing her because I asked

for her name to report her behavior.

After contacting the librarian's office, there is no record or

remembrance of this aspect of the report. This tactic of "bait and

switch" has been used on more than one occasion, by different entities.

After not being online for 3 days I saw where someone had requested an

Army Knowledge Online account in my name, or I should say my screen

name. I saw an attorney - John L. Knorek - from the firm representing my

former employer enter the philosophy department and ask for a librarian,

Kathy, by name.

Yee is the name of the head librarian at the State Library and the name

of a former employee of the United States Attorney's Office and HCRC,

did training for the Department of Justice, and worked for the

Massachusetts Attorney General. I sent most of this same information to

Sen. Ted Kennedy's offices in Massachusetts and was told during a

telephone conversation with the office that, being on the Judiciary

Committee, Sen. Kennedy could not get involved in judicial matters.

Since this is the only avenue I have been given, I have asked the

district offices of the DOL to investigate by CASPA, Sept. 2005, and

have asked for an investigation for discrimination due to the whistle

blower aspect of the matter.

I believe this will be my only chance at a modicum of justice. But I

will always believe that more realistically this situation can be

defined by, 18 USC 241, 242 and 245.

Hawaii, I now entertain, is a state where the dollar is God, and workers

are only by a necessary evil to facilitate that gain.

The Director of Labor and Industrial Relations, Nelson Befitel, has

unashamedly professed his desire, and that of the state to relieve the

department of any obligation to penalize businesses for infractions and,

I can see where the natural sequence would be to alleviate any scrutiny

that would expose abuse of power by the states employees.

It is no wonder; I have experienced what I have. All too often, in the

news here, the term "outsider" is given to any entity that would look at

what is practiced here. But there is a GOD that sees all and will affect

justice for the oppressed.

For the past two years at every step in this long railroad, from my

initial complaint filed at the EEOC, and subsequent to that, the HCRC;

the United States Commission on Civil Rights; the Department of Justice;

and finally through no effort of my own, having it wind up at the

Regional OSHA offices in San Francisco, I have steadily maintained that

I submitted a written complaint at the state HIOSH offices, here in

Honolulu.

I was told that much of what I sent to the DOJ had been sent to the San

Francisco OSHA offices. Evidently this written HIOSH complaint was not

among the papers.

Imagine my surprise when I got this letter from Mr. Traenkner, informing

me that I should not have made this a verbal complaint. I retrieved the

copy of the written complaint, made for me while at the HIOSH offices,

just to convince myself that those in power are the ones mistaken, and

now I believe with my whole being, they are in actuality, deceitful and

dishonest, practiced at covering up embarrassing incidents, and

downright criminal.

I am making a request to you for a review by your national offices,

where hopefully someone unbiased, with integrity, will do the right

thing. There was a Ms. Hirai in San Francisco that said she could see

the discrimination in this matter. Too bad it was not she that conducted

the investigation.

I only hope it is coincidence that there is a Hirai here in Honolulu

that is a lawyer and involved in the real estate business, and a lawyer

formerly in the firm representing my former employer.

Throughout this situation there have been relationships, I have noticed

in my opposition, which include professional, academic and familial. It

has long been my suspicion that those ensconced in the cronyism here in

Hawaii have at each step facilitated the lack of effort in this matter.

I am now sure of what I have long suspected. This cover-up goes much

further than what happens here in Hawaii.

Again, the black man is painted as the sole cause of a negative situation that should be faced by two parties, as well as the society at large.

Since coming to Hawaii, I have been able to see much in microcosm. One thing this smaller picture reveals is what I see as a really SICK antagonism here, between men and women. I know we've all heard of the war between the sexes. But here, there is a pathos and animus that I have not preceived anywhere else, on such a pervasive scale. I lean to the thought - albeit unschooled -that it is the result of what is left over from cultures abusive to women, and the long and prevalent presence of the military. So depressing. Really Sick.

Debra Loy, the public defender assigned to defend Denise Wright, told a jury yesterday that there are two victims in this case: Indigo and Denise Wright.

Loy said Denise Wright suffered from two mental illnesses — "acute chronic depression" and severe anxiety — as well as "personal disorders" that made her dependent on her husband and caused her to avoid situations that would create conflicts.

Although Loy said Wright failed to provide her daughter with "adequate nutritional" support, she did not intend to kill her.

Anger Has Its Place

No more than five or six minutes elapsed from the time the police were alerted to the possibility of a break-in at a home in a quiet residential neighborhood and the awful clamping of handcuffs on the wrists of the distinguished Harvard professor Henry Louis Gates Jr.

If Professor Gates ranted and raved at the cop who entered his home uninvited with a badge, a gun and an attitude, he didn't rant and rave for long. The 911 call came in at about 12:45 on the afternoon of July 16 and, as The Times has reported, Mr. Gates was arrested, cuffed and about to be led off to jail by 12:51.

The charge: angry while black.

The president of the United States has suggested that we use this flare-up as a "teachable moment," but so far exactly the wrong lessons are being drawn from it — especially for black people. The message that has gone out to the public is that powerful African-American leaders like Mr. Gates and President Obama will be very publicly slapped down for speaking up and speaking out about police misbehavior, and that the proper response if you think you are being unfairly targeted by the police because of your race is to chill.

I have nothing but contempt for that message.

Mr. Gates is a friend, and I was selected some months ago to receive an award from an institute that he runs at Harvard. I made no attempt to speak to him while researching this column.

The very first lesson that should be drawn from the encounter between Mr. Gates and the arresting officer, Sgt. James Crowley, is that Professor Gates did absolutely nothing wrong. He did not swear at the officer or threaten him. He was never a danger to anyone. At worst, if you believe the police report, he yelled at Sergeant Crowley. He demanded to know if he was being treated the way he was being treated because he was black.

You can yell at a cop in America. This is not Iran. And if some people don't like what you're saying, too bad. You can even be wrong in what you are saying. There is no law against that. It is not an offense for which you are supposed to be arrested.

That's a lesson that should have emerged clearly from this contretemps.

It was the police officer, Sergeant Crowley, who did something wrong in this instance. He arrested a man who had already demonstrated to the officer's satisfaction that he was in his own home and had been minding his own business, bothering no one. Sergeant Crowley arrested Professor Gates and had him paraded off to jail for no good reason, and that brings us to the most important lesson to be drawn from this case. Black people are constantly being stopped, searched, harassed, publicly humiliated, assaulted, arrested and sometimes killed by police officers in this country for no good reason.

New York City cops make upwards of a half-million stops of private citizens each year, questioning and frequently frisking these men, women and children. The overwhelming majority of those stopped are black or Latino, and the overwhelming majority are innocent of any wrongdoing. A true "teachable moment" would focus a spotlight on such outrages and the urgent need to stop them.

But this country is not interested in that.

I wrote a number of columns about the arrests of more than 30 black and Hispanic youngsters — male and female — who were doing nothing more than walking peacefully down a quiet street in Brooklyn in broad daylight in the spring of 2007. The kids had to hire lawyers and fight the case for nearly two frustrating years before the charges were dropped and a settlement for their outlandish arrests worked out.

Black people need to roar out their anger at such treatment, lift up their voices and demand change. Anyone counseling a less militant approach is counseling self-defeat. As of mid-2008, there were 4,777 black men imprisoned in America for every 100,000 black men in the population. By comparison, there were only 727 white male inmates per 100,000 white men.

While whites use illegal drugs at substantially higher percentages than blacks, black men are sent to prison on drug charges at 13 times the rate of white men.

Most whites do not want to hear about racial problems, and President Obama would rather walk through fire than spend his time dealing with them. We're never going to have a serious national conversation about race. So that leaves it up to ordinary black Americans to rant and to rave, to demonstrate and to lobby, to march and confront and to sue and generally do whatever is necessary to stop a continuing and deeply racist criminal justice outrage.

Hip-hop dance becomes a lesson for daughters

On May 18, my 12-year-old daughter came home from school excited about a dance she was practicing for the sixth-grade class graduation hoolaulea at Keonepoko Elementary School, in Pahoa.

My daughter gives me a form that tells what song and dance the kids will perform. After reading, I realized the kids were going to perform to a hip-hop song, which was noted as the "tootsie roll" by 69Boys. Obviously I became perturbed at the notion for a few sound reasons, which I ended up voicing to school administrators the next morning.

First, my wife and I told my daughter that she would not be performing that song and dance. I proceeded to explain to my initially upset daughter why I (as her father and a man of African lineage) could not allow her to participate in that particular activity as it stood.

I then explained to her that the song was full of explicit connotations about sex and that it presented an image of young black and Latino women as sexual objects for young black and Latino males. We printed the actual lyrics of the song to read with her (she had not actually listened to all the lyrics), and pulled up the video for the song. I then explained line by line the meaning of the lyrics while we observed the video.

By this time my oldest daughter had come into the room and was listening too. So I continued to explain to my girls why the images were degrading to women and a perversion of real hip-hop. I told them that large corporations produce songs and videos that create images of blacks and Latinos and present it as hip-hop so that ignorant people will see those images as cool and try to emulate them.

I also explained (as I have done concerning our African-American culture and history) that hip-hop is a living thing, a movement of people, a culture of endurance, struggle and triumph. Hip-hop is the voice of the oppressed against the oppressors, the voice of those crushed into poverty and violence, the voice of those who's cultures and heritage have been stolen away, perverted and destroyed.

Hip-hop is the means by which Afro-Latino people have reached out to each other in every corner of the globe, and affected the cultures of other peoples in the process, which is why even some struggling middle-class and poor white people, Hawaiians, Asians and other peoples relate to hip-hop; why we relate to each other.

Apparently some teachers at the school who are teaching the dance do not agree with me and have let the other children know that a parent complained and the dance could be canceled, which we never requested, but has now put some pressure on my youngest daughter from her classmates. How compassionate of the teachers. But I am very proud our daughter for holding her own and standing up to the status quo at her age.

I love my children, but my concern is not just for my children. Like I said, hip-hop is about community, and that means all the community, because we are all in this struggle together for justice and equality. Without justice and equality there is no peace. Without peace there is no victory.
Talk to your children, and listen to them, because they are like meters and you can gauge the motion of society and the direction of culture by them. But don't be afraid to draw the line even if you have to buck the status quo to keep them on the balanced path.

The Honolulu Liquor Commission is reopening an investigation into a bar that allegedly overserved a local playwright before she crashed head-on into another car on the H-1 freeway.

The case was shut after the bar closed, but investigators learned recently that another bar opened using the same liquor license.

Investigators believe Lisa Matsumoto had about 16 drinks at Slammers Bar & Grill, at 1683 Kalakaua Ave., between 11:30 p.m. and 2 a.m. Dec. 14, 2007. Matsumoto's blood alcohol content was .242

DeWayne McKinney, who spent nearly two decades in prison for an Orange County, Calif., murder he insisted he did not commit and went on to start a multimillion-dollar business in Hawai'i, has died after a scooter accident in Honolulu.

A 47-year-old man has died following a moped crash early this morning in Kaimuki, the city department of the Medical Examiner said.

He was identified as DeWayne McKinney. He was taken to The Queen's Medical Center, where he was pronounced dead.

McKinney was heading toward Kahala on Wai'alae Avenue about 12:38 a.m. today when the 2007 moped he was driving drifted to the right and left the road just before 14th Avenue, according to police.

He ran into a metal bus stop sign pole and then struck a wooden utility pole, vehicular homicide investigators said. He was not wearing a helmet, police said.

Police said he was thrown from the moped and landed on the street.

Alcohol use did not appear to be a factor but speeding may have been, police said.

The Los Angeles Time Web site is reporting that McKinney "spent nearly two decades in prison for an Orange County murder he insisted he did not commit and went on to start a multimillion dollar business in the Hawaiian Islands."

The Web site said, "McKinney made national news in 2000 after Orange County District Attorney Tony Rackauckas obtained his release from prison, saying he'd been wrongly convicted of a 1980 robbery-murder at a Burger King in Orange."

The report goes on to say "McKinney had parlayed a $1-million legal settlement with the Orange Police Department into a multimillion dollar ATM business on the Hawaiian Islands and had been in discussions with movie studio executives about turning his life story into a feature film."

It quotes Carl Stein, who owned a company that processed transactions for McKinney, who said at the time of his death, McKinney owned 42 ATMs on three Hawaiian Islands and had a net worth of more than $6 million.

Alcohol a factor in millionaire's moped wreck

A millionaire killed in a moped accident had a blood-alcohol level nearly three times the legal limit when he crashed into a bus stop sign in Kaimuki earlier this week, according to the Honolulu Medical Examiner's office.

Officials listed the cause of death for 47-year-old DeWayne McKinney as multiple internal injuries due to the collision, with alcohol intoxication as a contributing factor, said Dr. William Goodhue, first deputy medical examiner. Tests showed that McKinney's blood-alcohol level was .223.

3 more illegal aliens arrested on Big Island
Three more illegal aliens from China have been arrested as the Coast Guard searched for the fishing boat that brought them and six others to the Big Island, officials said.

The nine Chinese nationals were turned over to the U.S. Immigration and Naturalization Service in Honolulu, which was processing them for a removal hearing, INS District Director Donald Radcliffe said.

The aliens apparently got off the boat at a reef off Keauhou on Monday night before it headed back out the sea, officials said.

The INS believes the captain and engineer of the boat are Taiwanese, Radcliffe said.

The U.S. Coast Guard notified the Hawaii County Police Department on Monday night that a boat may have grounded off the west side of the island and several Chinese nationals may have left the vessel, police Lt. Glenn Nojiri said.

Police arrested the first six Tuesday night after receiving a report that several men speaking only Chinese had walked up to a home wanting to use a telephone, Nojiri said.

The remaining three, who apparently hid in bushes when their six companions were picked up, were taken into custody yesterday morning, he said.

Meanwhile, a Coast Guard C130 aircraft searched for the boat about 75 miles west-northwest of Kailua-Kona, Chief Petty Officer Tyler Johnson said.

Ever feel invisible?Like people don't really look at you, but around you or over you even through you, never admittingyou are there?Or you feel all too visible - identified, and negatively, just by what you look like? Well, one of Hawaii's leading black citizens said yesterday, that's a little bit of what it's like to
be black in Hawaii.

The Rev. Stanley E. Amos, pastor of the state's largest Afri-
can American Baptist curch, took time out from the speeches and rhetoric of the commemoration of Martin Luther King Jr.'s birthday yesterday to talk about the nitty - gritty of everyday racism in Paradise Amos, chair of the sate's Martin luther King Jr. Commission, was one of several speakers before hundreds who gath-
ered a Kapiolani Park yesterday for a unity rally fol-lowing the annual King Day
parade through Waikiki.

Many blacks come to Hawaii thinking they will escape racism
in this so-called melting pot of the Pacific, Amos said in an interview with The Advertiser. And many "have been sorely dissapointed." Amos said that as a pastor at
Trinity Missionary Bapist Church he is in a position to hear complaints of racism.

There may be some blacks who do not know the extent of the problem here, he said.
"Some still perpetuate the myth and try to live the myth that this place of paradise is a place where we can escape racism and discrimination and prejudice," Amos said.

"The fact of the matter is that we cannot. It still exists, and so painfully."It
exists in the school counselor who, Amos claimed, recently told a group of African
American students that "all blacks are stupid," Amos said.

It exists when the black job applicant, turned aside in the '60s because he was
"underqualified," is rejected in the '90s because he is "overqualified". Amos said he knows of instances in which blacks have come to Hawaii to try to start businesses and, "because of certain elements in place, whether it was the old-boy network or
nepotism in play, they wer not able to get into the market and get a grip on things and they had to call it quits and go back to the Mainland."

Because blacks represent only about 2 percent of the population of te stat(compared to 12percent of the nation's population), "the issues of the African American
community get lost easily and perhaps are not considered" very seriously, he said.

Blacks may also find themselves compared negatively to other minority groups, such as the recent immigrants from Asia who have distinguished themselves by bootstrap success stories and can't understand why blacks "can't do it too."

'To hold that view is to fail to understand the full history ofAfrican Americans, Amos said. "We are, after all, the one group that came to this country involun-
tarilly. The Indians and the Hawaiians were already here, and all the other groups
came under the rubric of immigrants.

"But we came here as an enslaved people, and beyond slavery, after the Emancipation
Proclamation went forth to free us from that, we still found ourselves victimized by Jim Crow laws."

Amos said he was not aware of any patterns of clear race discrimination in housing in Hawaii, although he said there have been instances of people taking racist actions against individual black families in their neighborhoods. But the economics of living in Hawaii magnify the historic impoverishment of blacks due to racism, he said.

Amos said blacks may repre-sent only 2 percent of the population, but nevertheless should be represented at least proportionally "when it comes to receiving fair and equitable distribution of goods and power in this state."

Fatal blow similar to teen crime

Prosecutors plan to use an accused killer's previous assault conviction as a juvenile as evidence of his "reckless state of mind."

Less Allen Schnabel Jr., 22, has been charged with manslaughter for fatally punching 34-year-old Christopher Reuther one year ago today, but as a teenager he was convicted of a similar crime that nearly killed another man.

Reuther was visiting Honolulu to consider attending law school at the University of Hawaii. On April 22 last year, Reuther was at Zablan Beach Park taking photographs when Schnabel allegedly false-cracked him, causing bleeding at the base of his brain.

When he was 17, Schnabel was convicted of first-degree assault in a similar incident at Nanakuli Beach Park after catching another man off guard with a punch, according to court documents.

On Sept. 1, 2002, the victim and Schnabel were at a birthday party with about 50 other people. A fight was about to begin, and the victim decided to leave before trouble started.

The victim went around shaking hands with various people "to be cool with everyone," including Schnabel, court documents state. When he shook Schnabel's hand, he was punched in the left side of his face, fell down and was kicked in the face by Schnabel several times.

The victim suffered a fractured orbital socket and backward displacement of his left eye. Medical officials said at the time that the victim nearly died and almost suffered a subdural hematoma, a traumatic brain injury.

FAMILY COURT WAIVERS

The Family Court has jurisdiction over youths under the age of 18 accused of committing crimes, but state law permits a Family Court judge to waive the court's jurisdiction over a juvenile and allow the youth to be treated as an adult.

For youths accused of murder, or attempted murder, the court may waive its jurisdiction if it finds "there is no evidence the person is committable to an institution for the mentally defective or retarded or the mentally ill."

The judge must assume the juvenile committed the crime.

Other factors that the judge might consider are:

Seriousness of the alleged offense

Whether the alleged offense was committed in "an aggressive, violent, premeditated, or willful manner"

The "sophistication and maturity" of the minor

The juvenile's history, including any Family Court record here or in other jurisdictions

Prospects for rehabilitation

Herman Frazier Herman Ronald Frazier, who is the 17th director of athletics at the University of Hawai‘i, hit the island in full stride in 2002 and has never looked back.

When the 51-year-old Frazier took over the reins of the UH Athletics Department, the budget was $16 million. In four short years, he has been able to increase it to $21 million.

Frazier, who enters his fifth year at UH, faces the everyday challenges of running a Division I Athletics Department head on. He has bolstered UH’s budget through various avenues.

"A handful of items definitely had to be addressed initially when I came on board," Frazier said. "We, as a department, have done a good job to try to resolve them."

The elimination of Aloha Stadium rent was high on his agenda, and the 2006 season is the first rent-free season for the Warrior football games since calling it home in 1975.

His goals of redesigning ‘Ahahui Koa Anuenue, the UH booster club; developing booster groups; setting up a better working relation with UH Foundation; initiating premium seat packages; and integrating the entire ticketing system have all come to fruition under his leadership.

Furthermore, he said he will continue the on going progress of upgrading facilities and improving the student-athlete experience both on the field and in the classroom.

"Facilities, on an overall scale, weigh heavily for our coaches in recruiting and the total student-athlete experience," Frazier said.

In 2005, the UH Tennis Complex was completed just in time for the Western Athletic Conference Championship. Also, a recent appropriation from the legislature will be directed toward refurbishing Les Murakami Stadium and renovating the lighting and stands at Cooke Field.

His ability to lead stems beyond the Pacific Rim into all corners of the world as evident by his last authoritative role - Chef de Mission of Team USA for the XXVIII Olympiad in 2004 in Athens, Greece. He is currently working with the USOC as a consultant on various issues.

Since 2001, he has received numerous honors, including the NCAA Silver Anniversary Award, which recognizes former student-athletes who have distinguished themselves after completing their collegiate athletic careers 25 years ago. In 2003, Sports Illustrated tabbed him one of the 101 most influential minorities in sports. He earned the distinction as one of the Top 50 Most Powerful Blacks in Sports in the March 2005 issue of BLACK ENTERPRISE magazine. Earlier this year, the NCAA honored him as one of the "100 Most Influential Student-Athletes," who have made a significant impact or major contribution to society. This award was presented in conjunction with the NCAA Centennial Celebration.

Frazier spent 23 years in the Athletics Department at Arizona State University before landing his first athletics director job at Alabama-Birmingham in 2000.

Before Frazier began building an impressive resume as an administrator, he was a multi-sport athlete at Germantown High in Philadelphia.

From there, Frazier launched his collegiate athletic career at Division III Denison University, and later at Arizona State, where he was an eight-time All-American and team captain of the 1977 national championship track team. He graduated from ASU in 1977 with a degree in political science.

Frazier made a name for himself in the Olympic arena running the leadoff leg of the gold medal-winning 4x400-meter relay team, while capturing a bronze medal in the 400-meter dash at the 1976 XXI Olympiad in Montreal. He was also a gold medalist at both the 1975 and ‘79 Pan-American Games and a member of the 1980 U.S. Olympic team that boycotted the XXII Olympiad in Moscow.

In the incident, the Dussells' car struck Pa'akaula's parked vehicle. The elder Pa'akaula allegedly punched Andrew Dussell, 26, in the head and face and kicked him while he was on the ground. Pa'akaula also allegedly punched Dawn Dussell, 23, and slammed her to the ground. Injuries to the couple included broken noses, concussions and facial fractures.

Pa'akaula's lawyer, Eddins, said in March that the Pa'akaula family "does not have one bone of prejudice in them," adding that Gerald Pa'akaula is half Hawaiian and half Caucasian.

During my latter time at Title Guaranty, when my complaint was active and shortly before I was terminated, there was a new hire.

His name was Wil Kahapea. On Title Guaranty's documents, he is listed as Asian Pacific Islander. On the EEOC documents, he is listed as Black. Is this the privilege of being "bi - racial"? I remember being told, by the headshake of a well known civil rights lawyer, that it is legal to claim either race when it is convenient and when it suits the individual. This could FIX a myriad of administrative problems. I could only wonder if something similar transpired here.

Hawaii ignores reality of racial discord:

The fact that the Waikele Center beatings are being prosecuted as simple assault rather than a racially motivated crime is another example of Hawaii trying to hide this unpleasant facet of island life for the sake of the tourist industry.
It was a decision motivated by politics and business, not by the facts of the case.

As long as Hawaii buries its head in the sand regarding local-haole relations, the violence will continue to get worse.

Regarding the Waikele assault case: Whether or not the Paakaulas committed a hate crime, one thing is for certain. Hawaii's dirty secret of institutionalized racism has been exposed for all to see.
Perhaps it's time for the parents of Hawaii to take this moment to think about the words they use and teach their children. It's long overdue for the "H" word to go the way of the "N" word. Just substitute the "N" word next time you hear someone use the "H" word and you'll get an idea of how it sounds to those to whom it's directed.

Hawaii justice will let the accused off easy
So the bullies who are accused of beating the couple senseless in Waikele are sorry (Star-Bulletin, March 16)?
Sorry might cut it if you accidentally cause harm to somebody, but not if you beat a woman unconscious and kick a defenseless, unconscious man's teeth in. But just watch, all it will take is a tearful apology in court with the defendants surrounded by a bunch of weeping relatives and our gutless judicial system will let them walk.

The Color Of Justice In Hawaii:

It appears to me, in one of these photos, the person is looking at a judge. In the other, the suspect's photo is a mug shot. Big difference to possible jurors.

Not to mention there is NO photo of the victim, with that of the accused, before the trial, in one group. I hope the lawyer in the childs case seizes the "apparent" wearing of brass knuckles, which could have been rings.

Freaky things happen here, in Hawaii. In one story I read of (a) punch, that knocks the victim down. In the other I read of a beating after the victim is knocked down and possibly dying. And there is no knowledge of the race or ethnicity of the victims in the Nakama case.

There also seem to be a deference to the wife of the victim, as far as her sentiments and statements.

One of two men convicted of attacking a pedestrian who asked them to move their car so his injured wife would not have to walk into a puddle was sentenced yesterday to a year in jail and five years' probation.

Circuit Judge Richard Pollack also ordered Maurice Nakama,(Local) 26, to serve 250 hours of community service at a rehabilitation center so that he could understand the damage he caused.

Murray Wallace suffered a brain injury in the October 2005 attack, which started as a verbal confrontation. He fell and hit his head after a scuffle on Kapiolani Boulevard with Nakama. Prosecutors say he likely would likely died had he not received prompt medical attention.

Murray Wallace was taken by ambulance to the Queen's Medical Center in critical condition, where he remains, police said.

Prosecutors charged Nakama with attempted murder, but in October a jury found him guilty of the reduced charge of second-degree assault.In imposing probation, Pollack relied on the verdict of the jury, which found that Nakama recklessly, not intentionally, inflicted serious bodily injury.

Pollack described the incident as senseless and entirely avoidable by Nakama and that the injuries Wallace suffered were substantial. But he agreed that it was unlikely that Nakama's conduct would recur and that he would likely respond to probation.

Wallace testified at trial that he could not remember what happened. He still suffers from short-term memory loss as a result of the head injury and continues to undergo therapy, prosecutors said.

Nakama apologized to Wallace and his wife, Alice, who also suffered a mild concussion after the driver, Daniel Miyamoto,(Local) struck her in the back of the head when she tried to stop him from leaving the scene. She suffered a mild concussion. At the time, she was wearing a leg cast.

Alice Wallace had asked that Nakama receive the maximum term possible, calling the attack on her husband "brutal and relentless."

Her husband lay on the ground unconscious and unable to fight back, yet Nakama continued assaulting him, she said.Nakama had no prior criminal history, said his attorney, Deputy Public Defender Ed Harada.

Miyamoto was sentenced in October to a year of probation with 30 days in jail to be served on consecutive weekends. He had pleaded guilty to third-degree assault for striking Alice Wallace.

Under a plea agreement, Miyamoto is expected to be sentenced next week to one year's probation and 30 days in jail.

Teen attack suspect to be tried as adult

A teenager who is accused of inflicting permanent brain damage to a 49-year-old visitor last year is being prosecuted for first-degree assault as an adult.

Corey Childs (Black) was 17 when police said he punched Preston Ingram in the face on the sidewalk in front of the Food Pantry Store July 29.

Ingram fell backward and hit his head on the sidewalk, knocking him unconscious, according to court documents.

Ingram, now 50, was taken to the Queen's Medical Center, where he underwent brain surgery, his wife, Barbara, said.

She said her husband suffered permanent brain damage and is still recovering from the attack in a rehabilitation facility in his home state of Virginia.

"He'll probably never work his job again. He'll never drive again," Barbara Ingram said.

Witnesses told police that Childs confronted Ingram, who was with some co-workers, then punched him, according to court documents.

Two witnesses told police that Childs appeared to be wearing brass knuckles when he struck Ingram.

Police arrested Childs near the Food Pantry Store Aug. 22, then released him to the custody of the state Family Court. According to the Honolulu Police Department's arrest log, Childs has no local address. He turned 18 last September.

Family Court Judge Frances Wong waived jurisdiction over Childs on Tuesday, allowing police to charge him as an adult yesterday. Police also charged Childs with two counts of driving a stolen car for incidents that occurred last April.

His bail is $35,000. He was scheduled to make his first court appearance on the assault charge this morning.

Barbara Ingram said she is pleased Childs is being prosecuted as an adult to face stiffer penalties than if he were prosecuted under the juvenile justice system. But she said whatever punishment he receives will not equal the damage he inflicted."This boy will never suffer anywhere near what I suffered, what my husband suffered, what the family is suffering and what we're going through financially," she said.

Ingram said her husband arrived in Hawaii July 24 to do some work on a ship at Pearl Harbor. He works for diesel engine maker Fairbanks-Morse. She said her husband and his co-workers were supposed to be in Hawaii for only a week, then head to San Diego for some sea trials for another week and then head home.

She said her husband does not remember the attack or even being in Hawaii. But she said he knows he was assaulted and that people are trying to help him.

Child rape suspect appears in court

The lawyer for a man accused of raping a 4-year-old girl in her Kalihi backyard Monday night said his client is pleading not guilty to first- and third-degree sexual assault and burglary in the second degree this morning.

Shane Ngirmidol, 31, who has no permanent local address, was barefoot when he appeared in District Court, wearing black athletic shorts and a sleeveless, silver-and-blue, V-neck athletic shirt. He was shackled at the ankles and wrists when he was escorted into the courtroom.
Ngirmidol had bail set at $50,000 for the more serious charges and $500 for an unrelated case that was not disclosed in court.

A preliminary hearing was scheduled for Tuesday. The burglary charge stems from the accusation that Ngirmidol unlawfully entered a storage shed where the girl allegedly was sexually assaulted.

According to police, the girl was playing in the fenced-in backyard of her Kalihi home on Palama Street around 7 p.m. when she was attacked by a man who climbed over a chain-link fence and lured her into a darkened tool shed on the property.

The girl was being treated at Kapiolani Medical Center for Women & Children the next day when her mother told sex crime investigators that her daughter was sexually assaulted by a stranger who had dark skin, curly hair and smelled.

The girl told investigators that she was alone with the man in the tool shed and that he had given her $1, according to a police affidavit filed in court.

A police graphic artist made two composite sketches of the suspect and a convenience store owner told police Tuesday that a man matching the description had just left his store, which is located on the same Palama Street property, according to the affidavit.

Just after 5 p.m. Tuesday, officers stopped Ngirmidol alongside Tamashiro's Market at Palama and North King streets and asked him to stand in a field lineup, according to the affidavit.

Ngirmidol was arrested after he was identified by another girl who said she saw him on Palama Street around the time of the attack, according to the affidavit.

Charges dropped, but no jail release

But Ngirmidol remained in custody at O'ahu Community Correctional Center, unable to post bail of $500, on five charges of assault and criminal property damage, according to Louise Kim McCoy, Department of Public Safety spokeswoman.

The charges relate to a 2003 case, according to Jim Fulton, executive assistant with the city prosecutor's office.

Ngirmidol is accused of misdemeanor third-degree assault and fourth-degree criminal property damage. He is charged with throwing an object at someone's head and damaging a car and a wooden gate the morning of July 4, 2003, Fulton said.

He was later charged with contempt of court for not showing up for his case
